Backlog of Social Security Disability cases at the Initial and Reconsideration Levels at DAS/DDS

Backlog of Social Security Disability cases at the Initial and Reconsideration Levels at DAS/DDS There are 1 million cases pending at DAS/DDS in all the states, and 32,000 in Georgia as of February 2022. Pre-covid, it used to take 3 to 6 months to get a decision at the initial or reconsideration levels, but now there are long delays and it can take upwards of 1 year. Due to these delays we recommend that clients file a congressional inquiry and have their case marked homeless if applicable. In some cases, adjudicators aren't catching when cases are marked homeless, but our office will follow up until it is done. If you file a disability claim in Georgia, your case could be sent to another state that is not facing a significant backlog. However, your case will be sent back to Georgia if you are scheduled for a Consultative Evaluation with a doctor. Unfortunately, three out of five doctors are no longer doing consultative exams for social security. In some cases you can travel to another town or hold your exam virtually in order to speed up this process. Although all cases are moving slowly through the initial and reconsideration levels, our cases moving fast at the hearing level since we continued to do virtual and phone hearings during 2020. Please watch the rest of our videos to learn more about applying for disability and how the Law Office of Kathleen Flynn can help.
